Service of process in Jamaica

Jamaica is our home desk, and has been since 1988. We are not an agency forwarding your file to a stranger — the people who walk up to the gate are our own, working out of St Mary, and we serve all fourteen parishes island-wide.

What the Jamaica desk handles

  • Personal service of summonses, complaints and petitions
  • Divorce and family matters, including non-molestation orders
  • Claims for possession and statutory demands
  • Bankruptcy petitions and letters before action
  • Corporate service at a company’s registered office or place of business
  • Trace and locate before service, where the address you hold is stale
  • Court filing and document retrieval in Kingston
  • Affidavits and inheritance letters
  • Swearing of the Affidavit of Service before a Notary Public, Justice of the Peace or attorney
  • Legal prison visits

Jamaica is the size of Wales.....but shorter by 20 miles. The whole of the Eastern Caribbean islands will fit into Jamaica (bar Guadeloupe) and there would still be a 1/3 of the island empty.

Addresses in Jamaica: what firms need to know

This is the part that catches out firms instructing Jamaica for the first time. An address that looks incomplete on paper is often perfectly serviceable — and an address that looks complete is sometimes nowhere near enough.

Not every house is numbered, and not every street is named

Outside the main towns, houses are frequently unnumbered and lanes unnamed. Local knowledge, not a map pin, is what finds the door. A district name, a nearby landmark, a shop, a church or a school will usually do more for us than a tidy-looking street address that does not exist on the ground.

Hill and gully: time, not distance

Inner Jamaica is hill and gully country. The question is never how far an address is on the map but how long it takes to reach. Twelve miles inland can be an hour and a half of climbing, and a route that is passable in the morning may not be after heavy rain or when a truck has tipped over, or the pot holes have turned into a crater. When we quote you, we are quoting for the time the road takes, not the mileage.

Nicknames matter more than you would think

Many Jamaicans are known locally by a nickname rather than the name on the writ. John Brown may be known in his district as “Mass Blood”, “Rat”, “Blackie” or “Ting Man”. If you ask for John Brown in the district, you may be told truthfully that nobody of that name lives there.

Or, it will raise suspicion, and the person you asked will say they don't recognise the name. That same person may then call the Defendant/Respondent to say a suspicious person was asking for them — ending the process server's element of surprise.

If your client, your instructing attorney or the plaintiff knows a nickname, send it to us. It is often the single most useful line in the file.

Mail goes to the post office

In much of rural Jamaica post is collected from the local post office rather than delivered to the door, so a postal address in a file may be a collection point and not a residence. Tell us if the address you hold came off correspondence — it changes how we approach it.

Service can be done at the local post office. We simply attend and confirm with that local office the Defendant/Respondent receives mail there. We can serve by posting the documents through the Jamaica Postal Service — obtaining the Post Mistress name and Proof of Postage (a photo), then checking back seven days later to confirm the documents have been collected.

Most Jamaicans only visit their local post office about once a week, if they're expecting anything, and maybe two or three times a month to collect utility bills.

Once we've confirmed the package has been taken, we provide an Affidavit of Substitute Service stating the dates and time delivered or confirmed collected.

Descriptions and relationships

A physical description, an age, an occupation, the name of a partner or relative, a workplace, or the kind of vehicle someone drives will all help us confirm we have the right person before the documents change hands. Where the defendant is one of several people of the same name in a small district, that detail is what prevents a bad serve.

Where an address is thin. We would rather run a trace first than burn your fee on a wasted journey. Ask us before you dispatch and we will tell you honestly whether what you hold is enough to work with.

Timing and what comes back to you

Kingston, Montego Bay, Ocho Rios, Mandeville, Spanish Town and the coastal corridor are straightforward. Deep rural and interior addresses take longer, and we will tell you how much longer before you commit, not afterwards.

  • A single point of contact at this desk for the life of the file
  • Progress updates by email, or by WhatsApp if you prefer
  • Multiple visits to the address, and inland travel, within the fixed fee
  • Personal service, or service on a reasonable adult at the address where that is proper
  • Any question you need put — for example whether the respondent is serving in the military. Do not assume we will always ask as it may not be necessary. We know New York State requires that question. Let us know in advance should your service need it to be asked.
  • A court-ready Affidavit of Service sworn locally by a Justice of the Peace, plus a signed Certificate of Service. Both are of no additional fee.
  • The scanned sworn Affidavit emailed to you before the original leaves us.
Should you require a Notarised Affidavit of Service there will be an additional swear fee.
  • Courier of the original sworn affidavit back to your office
  • Photographs of the location where lawful and practical
  • A written report of attempts made where service proves impossible — often what the court needs in itself

Why the Jamaica desk, specifically

Our senior investigator, Winston Hayles, has worked Jamaica since 1988 and is based between St Mary and London. Leslie Grossett is a licensed bailiff and tracer on the island, and Camille Mighty handles court filing and document retrieval in Kingston. The office itself sits at Tower Isle in St Mary — ten minutes from Ian Fleming International Airport, thirteen minutes from James Bond Beach and about ninety minutes from Kingston.
