Service of process in Curaçao

Curaçao is a Dutch jurisdiction, and that changes things in ways a US firm will not expect. We hold an associate licensed bailiff position here, and this is also our route into Aruba, Bonaire, Sint Maarten, Saba and Sint Eustatius.

What the Curaçao desk handles

  • Personal service of summonses, complaints, petitions and subpoenas
  • Corporate service at a registered office or place of business in Willemstad
  • Service on directors, managers and authorised representatives
  • Divorce, family and probate documents
  • Debt, judgment and enforcement documents
  • Trace and locate before service, where the address you hold is stale
  • Service on Aruba, Bonaire, Sint Maarten, Saba and Sint Eustatius
  • Document retrieval and certified copies
  • Swearing of the affidavit before a notary or attorney

If what you have is not on this list, ask. We will tell you plainly whether it can properly be served here.

Dutch law, Dutch language, and island addresses

Two things decide whether a Curaçao instruction goes smoothly, and neither is distance.

The first is the document. This is a Dutch jurisdiction, not a common-law one. Depending on the document and the proceeding, the correct route may be service by a local deurwaarder rather than personal service by us, and your document may need to be in Dutch to be of use. We will tell you which applies to your file before you send it — and then we arrange it, whichever route it is. We do not hand you a directory and step back.

The second is the address. Dutch Caribbean addressing often gives a district name and a house number with no street at all, and plot numbers repeat across districts. Papiamentu is the language of the street even where Dutch is the language of the paperwork, so the name you have on the complaint may not be the name a neighbour recognises. Send us any nickname, employer or telephone number you hold.

On Sint Maarten there is the additional question of which side of the border an address falls on — the Dutch side or the French side — because that decides the procedure entirely. Tell us the street and district and we will confirm it before anybody travels.

Sending a document drafted only in English? Ask us first. It may still be workable, or it may need a Dutch translation to be accepted — and it is far cheaper to establish that before service than after.

Timing, and what comes back to you

Willemstad is usually a matter of days. Aruba, Bonaire and Sint Maarten depend on the inter-island flight schedule; Saba and Sint Eustatius are smaller and less frequently served, so we quote those individually and honestly.

  • A court-ready Affidavit or Certificate of Service, sworn locally
  • A record of every attempt — date, time, address and who was spoken to
  • A description of the person served and the circumstances of the handover
  • Photographs of the location where lawful and practical
  • Progress updates by email or WhatsApp while the matter is live
  • A reasoned report if service cannot be effected, with what we established about the true address
  • A single point of contact who knows your file, start to finish

Why instruct us in Curaçao and the Dutch islands

Because we hold an associate licensed bailiff position here and work in Dutch, and because we will tell you at the outset whether your document needs a deurwaarder, a translation, or both — and then handle it.

There is a full Dutch version of this information, written rather than machine-translated, for Dutch-speaking correspondents at nl.html.

We work in Dutch and report to you in English. Ask us about the correct route and any translation requirement before you send. If the formal route is a local deurwaarder, we instruct the right one, follow it through and return the document to you — you keep one point of contact throughout, and the investigative work on the address stays with us.
