Service of process in Dominica

Dominica is mountainous, heavily forested and thinly roaded — which is the single most important thing to understand before you send an instruction here. It is also a citizenship-by-investment jurisdiction, so a proportion of the work concerns people whose connection to the island is a document rather than a home.

What the Dominica desk handles

  • Personal service of summonses, complaints, petitions and subpoenas
  • Corporate service at a registered office or place of business in Roseau
  • Matters connected with citizenship-by-investment records and agents
  • Divorce, family and probate documents
  • Claims for possession, statutory demands and letters before action
  • Trace and locate before service — frequently the larger part of the work
  • Discreet enquiries to establish whether a person is genuinely resident
  • Court filing and document retrieval in Roseau
  • Swearing of the Affidavit of Service before a Notary Public or attorney

If what you have is not on this list, ask. We will tell you plainly whether it can properly be served here.

Mountains, villages, and the resident who is not resident

Two quite separate difficulties, and it helps to know which one your file has.

The first is geography. Dominica’s interior is mountain and rainforest, and the settlements sit around the coast linked by roads that wind. A village on the east coast is not twenty minutes from Roseau. Village-and-landmark addresses are entirely normal here and we can work with them, but an attempt in a distant village is a planned half-day, not an errand, and we price it that way once rather than adding travel afterwards.

The second is the investor address. Where a defendant holds economic citizenship, the address on your file may be an agent’s office, or a property held but never occupied. Serving it achieves nothing. Tell us what your address actually came from and we will establish, before any attempt, whether the person is on the island at all. A reasoned finding that they are not is a proper result and often more use to you than an empty affidavit.

After major storms, rebuilt and relocated housing has left a good many older addresses out of date. If your address predates that, treat it as a starting point and let us verify it first.

Timing, and what comes back to you

Roseau and nearby is usually days. Distant villages are planned around the roads and the weather. Where the work is really a trace we quote the enquiry and the service together, in writing, before starting.

  • A court-ready Affidavit or Certificate of Service, sworn locally
  • A record of every attempt — date, time, address and who was spoken to
  • A description of the person served and the circumstances of the handover
  • Photographs of the location where lawful and practical
  • Progress updates by email or WhatsApp while the matter is live
  • A reasoned report if service cannot be effected, with what we established about the true address
  • A single point of contact who knows your file, start to finish

Why instruct us in Dominica

Because we will tell you plainly whether you have an ordinary serve or a trace dressed up as an address — and because a village address that means nothing from a desk in New York means something to somebody who knows the island.

And because we quote the travel once, up front, rather than presenting it later as a disbursement.

English throughout, with Kwéyòl widely spoken in the villages. Ask us about the correct service route before you send and we will confirm the appropriate method for your particular document.
