Caribbean Process Server

Compliance & Validity

Q: Do you understand the Rules of Civil Procedure in [jurisdiction]?

A: Yes. We have been operating under the Code of Civil Procedures (or equivalent rules) in each jurisdiction since 1989. Our licensed bailiffs and process servers are trained on the specific service requirements, permissible methods, and documentation standards of every island we cover. We do not performgeneric service — every serve is jurisdictionally compliant.

Q: What constitutes good service in your jurisdiction?

A: Good service (also called valid service or proper service) varies by jurisdiction. In common law jurisdictions like Jamaica, BVI, and the Bahamas, personal service on the defendant is the gold standard, with substituted service available upon court order. In civil law jurisdictions like Curaçao and the Dominican Republic, service by a licensed bailiff (huissier de justice/gerechtsdeurwaarder) is typically required. We advise on the correct method before attempting service and document every step to establish compliance.

Q: Will your process server appear in court if service is contested?

A: Yes. Our process servers and licensed bailiffs are available to testify as neutral third parties regarding the manner, time, and circumstances of service. We prepare detailed witness statements, coordinate with your litigation team for direct examination, and are experienced in cross-examination. Court appearance is included at no additional fee for local courts; travel to other islands is billed at cost. In 35+ years we hacve never been summoned to attend court in relation to documents served.

Q: How do you handle invalid service risk?

A: We mitigate invalid service risk through a four-layer compliance protocol: (1) pre-service jurisdictional review to confirm the correct method; (2) multiple attempts to demonstrate due diligence; (3) comprehensive documentation (GPS photos, video, detailed reports); and (4) attorney-solicited sworn affidavits formatted to court standards. In 30+ years, our service documentation has survived every contested service challenge.

___________________________________________________________________________________________________

Q: Are your affidavits attorney-solicited and notarized?

A: Yes. In jurisdictions requiring attorney-solicited affidavits, we coordinate with local attorneys to prepare and witness the sworn statement. Where notary public services are available, we provide notarized affidavits. In jurisdictions where notaries are uncommon (e.g., certain Eastern Caribbean islands), we use Justice of the Peace certifications, which are equally valid under local law. We always confirm the specific evidentiary requirements of your court before preparing documentation.

Documentation & Proof

Q: What proof of service do I receive?

A: You receive a complete service package: (1) a sworn affidavit of service detailing the manner, date, time, and location of service; (2) a Certificate of Service with Notary Public or Justice of the Peace attestation; (3) GPS-tagged photographs of the service location; (4) a detailed description report of all attempts; and (5) the return of service document formatted for court filing. If video was obtained, it is included as a secure download link.

___________________________________________________________________________________________________

Q: Do you provide GPS-verified photo evidence?

A: Yes. Every service includes, as standard, high-resolution photographs with embedded GPS coordinates and timestamps. These images document the service location (house number, business signage, street view), any access issues (gated communities, security), and the general condition of the premises. This visual evidence is included as Exhibit "B" to your affidavit and has been admitted as evidence in contested service hearings.

___________________________________________________________________________________________________

Q: Can I track the status of my service in real time?

A: Yes. We provide real-time human status updates via WhatsApp or email at every stage: document receipt, first attempt, subsequent attempts, successful service, and affidavit completion.  We update you once we hear back from our local agent ....day or night.

___________________________________________________________________________________________________

Q: Do you handle Apostille and legalization for international enforcement?

A: Yes. We provide, if required,  Apostille certification through the relevant government office (e.g., Ministry of Legal Affairs, Attorney General’s Chambers) for all Hague Convention member states. For non-member states, we manage full legalization through diplomatic channels. This service is available as an add-on and is essential when you need to enforce a foreign judgment based on our service documentation.

Speed & Deadlines

Q: What is your standard turnaround time?

A: Standard personal service is completed within 48 hours to 5 business days, depending on the jurisdiction and defendant’s location. Registered agent service is guaranteed within 48 hours. Rush service (24-hour) and same-day service (4–8 hours) are available in major metropolitan areas for an additional surcharge.

___________________________________________________________________________________________________

Q: Can you meet statutory deadlines?

A: Yes. We understand that statutory deadlines are non-negotiable. When you engage our rush or same-day service, we treat your deadline as our deadline. We perform pre-service compliance reviews to ensure no procedural delays and update you so you and your end client are informed of the reality on the ground and we provide accelerated affidavit preparation so you have proof of service in hand before your filing deadline.

___________________________________________________________________________________________________

Q: Do you serve on weekends and holidays?

A: Yes, where legally permissible under local law. In many Caribbean jurisdictions, personal service is valid any day of the week, including weekends and public holidays. We confirm the permissibility before scheduling and bill a holiday surcharge only when service occurs on a recognized non-business day. Most courts will not accept service on a Sunday. However, if the court allows and we know the Defendant/Respondent attends church we have been known to serve outside the church building. Never inside.

Coverage & Capabilities

Q: Which Caribbean jurisdictions do you cover?

A: We provide full coverage in 12+ jurisdictions with licensed bailiffs or process servers in each: Jamaica, Trinidad & Tobago, Bahamas, Barbados, British Virgin Islands (BVI), Cayman Islands, Curaçao, Antigua and Barbuda, St. Kitts and Nevis, Grenada, Dominica, St. Lucia, St. Vincent and the Grenadines, and the Dominican Republic. We also coordinate service in additional islands through our agent network.

Q: Can you serve defendants who have been deported by ICE?

A: Yes. ICE deportee tracing is one of our specialized services. We locate individuals who have been removed to their Caribbean country of origin and perform personal service once located. This is common in foreclosure, family law, and debt collection matters where the defendant was previously resident in the U.S. Our Immigration Tracing Service (ITS) is an additional service ideal for these cases where our immigration contacts can confirm flight arrival date and given landing address. Generally within 48 hours. Additional trace fee applies.

Q: Do you serve offshore companies in BVI, Bahamas, St. Kitts & Nevis and Cayman Islands?

A: Yes. We regularly serve BVI companies, Cayman Islands funds, Bahamas, St. Kitts & Nevis and other offshore entities. We verify the current registered agent through the local companies registry, confirm good standing, and serve at the registered office or principal place of business. We also map complex corporate family structures when the immediate entity is a shell or subsidiary.

___________________________________________________________________________________________________

Q: Do you provide references from other attorney-clients?

A: Yes. Upon request, we provide references from litigation paralegals and attorneys who have used our services in contested matters. We also maintain a Google review profile with verified feedback from legal professionals. We understand that peer validation is critical when selecting a process server for high-stakes litigation.

Pricing & Billing

Q: Is your pricing really all-inclusive?

A: Yes, for 98% of matters. Our standard flat rate covers multiple attempts, inland travel, documentation, and real-time tracking. The only time additional fees apply is when you request rush service, when the defendant’s address is unknown (requiring skip tracing), when off-island travel is necessary, or when international certification (Apostille) is required. We notify you before incurring any additional charges.

___________________________________________________________________________________________________

Q: Do you offer Net 30 terms for law and process serving agent firms?

A: Yes. Verified law firms on monthly retainer or with established billing history receive Net 30 invoicing terms. We also accept all major credit cards and wire transfers for international clients. For high-value or complex international matters, escrow arrangements are available. We also charge a 20% Late Payment Fee on all outstanding balances past the 30 day Due Date.

___________________________________________________________________________________________________

Q: What is your refund policy if service is impossible?

A: If, after exhaustive due diligence and multiple attempts, service is genuinely impossible (e.g., defendant deceased, permanently left jurisdiction, address non-existent), we provide a detailed impossibility report and refund 50% of the service fee. If we recommended skip tracing and you declined, and service subsequently fails due to bad address, the full fee applies — which is why we always recommend verify-before-serve.

Technology & Communication

Q: How do I submit documents for service?

A: You can upload documents via our secure client portal, email encrypted PDFs, or send them via WhatsApp with document attachment. We accept all standard legal document formats and confirm receipt within 30 minutes during business hours. For urgent matters, WhatsApp is the fastest channel.

___________________________________________________________________________________________________

Q: Do you offer a client portal for matter management?

A: No. Because our existing clients, for now, prefer the personal touch and how we update them immediately when there is something they should know.  We work together like friends on a team aiming for the same results.
